The High Court in Mombasa has directed a petitioner to explain why he is seeking to have the results which were used to declare Mombasa Governor Hassan Joho winner in the August 8 election investigated.Mr Mohamed Abdi Daib who vied for the Changamwe parliamentary seat on a Jubilee Party ticket but lost to ODM’s Omar Mwinyi wants the court to order for investigations into the poll results.Mr Daib in his petition wants the court to order a probe into why there are two different reports on forms 37B regarding how many votes Joho garnered in Changamwe during the August 8 election.Justice Njoki Mwangi, has, however, directed Daib to explain why the court should order for an investigation into the two conflicting results in Changamwe.Daib through his lawyer Gikandi Ngibuini had filed the application for the probe alleging fraud on the forms in question.According to Ngibuini, the petition filed by his client shows that Joho got 53,804 votes while the petition filed by former Senator Hassan Omar against the Governor indicates that he garnered 41,893 votes in Changamwe.The lawyer told the court that when Changamwe returning officer Aisha Abubakar gave her evidence in court, she said Form 37B showed Joho had 53,804 votes while county returning officer Nancy Kariuki’s document showed that the governor got 41,893 votes in Changamwe.Justice Mwangi ordered parties in the case to file their submissions before the next case hearing when she will give a ruling on whether investigations will be done on the results.The case will be heard on January 12, 2018.
