Jubilee Party has suffered a blow, after The Court of Appeal quashed its direct nomination of Rachel Nyamai as its parliamentary candidate for Kitui South.
Giving the ruling on Friday, a three-judge bench ordered the party to conduct fresh nominations within the next 48 hours.
Justice Aggrey Mchelule had earlier given the party a greenlight to nominate Nyamai, but the ruling was overturned by Judges Paul Kariuki, Agnes Murgor and Stephen Kairu.
The ruling follows a petition by former Kitui South MP Sammy Kiminza, who had challenged Justice Muchelule’s decision.
Kiminza had opposed the direct nomination of Nyamai, with lawyers Jemimah Keli and Omwanza Ombati telling the judges that Kiminza had paid Sh5,000 for the nominations but the exercise was never carried out.
According to Keli voters in Kitui South had been denied an opportunity to exercise their democratic right of electing a leader of their choice.
