President Uhuru Kenyatta’s Jubilee Party has written to the Director of Public Prosecution Keriako Tobiko calling for the arrest and prosecution of NASA campaign head Musalia Mudavadi and the coalition’s lead lawyer James Orengo.In a letter dated September 22 and copied to IEBC Chairman Wafula Chebukati, Jubilee Secretary General Raphael Tuju claims Mudavadi and Orengo illegally accessed IEBC servers to obtain results for the August 8 presidential election.“We request your good office to expeditiously direct comprehensive investigations, and prosecution if your investigations uncover sufficient evidence, pursuant to the provisions of the IEBC Act, Election Offences Act and Communications Act, Penal Code and any other law against Hon Mudavadi and Senior Counsel James Orengo and any other person who had unauthorized access to the IEBC Servers,” the letter signed by Tuju reads in part.Tuju says through NASA’s numerous press briefings since August 8, Mudavadi and Orengo have continuously said that NASA is in possession of the results contained in the IEBC servers indicating that Raila beat Uhuru with over two million votes.“NASA leaders have held numerous press conferences at which they claim to be holding data and information in IEBC’s systems which could only have been accessed unlawfully or which is false information deliberately disseminated to undermine the electoral process,” the former Rarieda lawmaker said.NASA has maintained Raila beat Uhuru during the August 8 presidential election but claim the poll was rigged in favour of Uhuru.
