Justice Aggrey Muchelule has adjourned an election petition filed by Former Kathiani MP Wavinya Ndeti against Machakos Governor Dr. Alfred Mutua. 

According to the Standard, the case against the Maendeleo Chap Chap Movement Leader will resume on January 8, 2017. In a sworn affidavit County Returning Officer, Joyce Wamalwa, said that the election were free and fair. 

She also insisted that the results declared were a true reflection of the will of the people of this part of the nation.

 “The results I declared at the county tallying center were the same ones I received from the various constituency tallying centers as submitted by respective returning officers,” she said.

The incumbent governor, who started his second term in office, had asked the court to summon an document expert from the director of criminal investigations office to probe the affidavits filed by Ndeti, a Wiper candidate.

Mutua argued that some of the affidavits are fake, adding that they cannot be used in the case seeking to change the outcome of the August exercise.

The county boss has maintained that he defeated his competitor through the right channels. Ndeti has, however, said that the exercise was marred by all sorts of illegalities and irregularities that saw her lose to the county boss in one of the most watched races at the county level.
