The High Court in Mombasa on Tuesday failed to deliver a judgment in a case filed by a University lecturer seeking to stop the implementation of the new education system.Erick Mugambi, a Mathematics lecturer at the Technical University of Mombasa had moved to court seeking orders to restrain the Kenya Institute of Curriculum Development and Ministry of Education from switching from the 8-4-4 to the 2-6-3-3 system.Justice Erick Ogola, however, said he could not write the judgment because of the election petitions he is handling, which he said have taken a lot of his time.Mugambi had filed the petition saying he wants to protect the rights of Kenyan students, arguing that he believes the recommended curriculum violates the rights of the child under the constitution.Mr Mugambi in his suit papers had said that various education stakeholders were not consulted before the Ministry of Education came up with the new education system.He said if the new system is implemented, it will cause confusion among students, teachers and the entire education system.The lecturer said the system developers erred in seeking to introduce indigenous and foreign languages at different levels, adding that if such languages are introduced at an early level, it will negatively affect the student’s ability to communicate in Kiswahili and English.
