A Judge on Wednesday surprised a court session when he freed men accused of killing a police officer saying God will sentence the accused.
High Court Judge Evans Makori said prosecution did not present adequate evidence to prosecute the accused but told the suspects that whoever killed the police officer will face the wrath of God.
Those accused were Jacob Chanze, Safari Nazro, Athman Nzeni, and Karaga Kombe. They had been accused of killing Corporal Athenus Kilonzo on December 11, 2014 at Kimarani, Kaloleni Kilifi County.
Kilonzi is said to have been gunned down by one of the accused after they attacked him.
Kilonzo after the attack according to prosecution tried to shoot the accused but the G3 gun he had failed to work.
He was beaten by the four until he died. Other unarmed officers, Dominic Emoli and Sam Sora who were with Kilonzi were also beaten but they managed to escape.
''If anyone of you killed the officer, then be ready to provide an answer before God," Judge Makori said as he freed the four.
Other three suspects claimed to have been in the company of the accused were not in court at the time Judge Makori concluded the case.
