A judge constituting the bench to hear a case that seeks to force the IEBC to exclusively use the electronic system in the August 8 elections has disqualified himself from the bench.
Justice William Musyoka recused himself citing former engagement a NASA principal.He said that since he once practiced with one of the Nasa bosses, it would be improper of him to hear the case.
Justice Musyoka was recently appointed by Chief Justice David Maraga to constitute the bench to hear the case alongside Justice George Kimondo and Justice Hedwig Ong’udi.
Through lawyer Paul Nyamodi, the Independent Electoral and Boundaries Commission (IEBC) had requested Maraga to appoint a bench of at least three judges or any uneven number to hear and determine the dispute.
