A Kiambu judge hearing a case in which former principal was charged with killing her husband has declined to quit from hearing the matter on grounds that he is biased.

The accused, Jane Muthoni, who served as the head teacher at Icaciri Secondary School in Gatundu and co-accused Isaac Ng'ang'a claimed that Kiambu High court judge Joel Ngugi is biased and should quit hearing the case.

Muthoni and Ng'ang'a denied killing Solomon Mwangi, the former Kiru Boys Secondary School principal.

According to them, the judge will not accord them a fair trial.

They argued that Judge Ngugi was unfair when he denied them bail and the matter should be transferred to a Nairobi court.

Ngugi on Wednesday said the claims by the suspects are illegitimate and unsubstantial which cannot make him quit hearing the case.

"I am not biased in this criminal case. I have the predisposition not permitted by facts and law to decide the case in a certain way. The application is hereby dismissed", said Ngugi.

The Judge said if he quits the case will bring public disfavour to the court and himself, adding that judge can't  avoid cases. 

The case will be mentioned on December 21 and hearing resumes on January 22.
