The tribunal hearing Tunoi's case is set to determine whether to listen to the remaining witnesses or not since the judge has retired.

On Monday last week, Justice Tunoi's lawyer Fred Ngatia, asked the tribunal chaired by Sharad Rao, to end the investigations which the tribunal had called on lawyers to attest.

The tribunal did not stop its investigations so it still can hear arguments by lawyers.

Ngatia argued the Judicial Service Commission did not carry out investigations before making its recommendations and only relied on findings by Judiciary officer, Kennedy Bidali.

Prior responding to President Uhuru Kenyatta, the tribunal needs to listen to the accused (Tunoi) and all the witnesses.

Tunoi is being investigated of bribery claims where he is accused of receiving a bribe from Nairobi Governor Evans Kidero.
