Just moments after former Kilome MP Harn Mwau filed a petition at the supreme court challenging the validity of Uhuru Kenyatta’s win, another petition has been filed to block the court from hearing the case.
In an interview with the media, Kelvin Njihia, a lawyer, who filed the case outlined a number of reasons why justices at the court must not be allowed to go on with the case.
“The Judicial Service Commission should come out and pronounce the current bench of judges unfit to hear the case as per constitutional provisions,” said the lawyer.
According to the lawyer, deputy chief justice Philomena Mwilu, justice Ibrahim Mohamed and justice Isaac Lenaola should not be allowed to hear the case.
He argues that justice Ibrahim has been too absent from the bench and in his current state is incapacitated. He, therefore, argued that his position should be announced as vacant.
Njihia also said justice Philomena Mwilu and Isaac Lenaola have a number of pending integrity issues that must be looked into before they are allowed to preside over the case.
