JSC filed an application before high court judge Chacha Mwita seeking justice Ndungu to defend herself in person after filing an affidavit against, a petition filed by Apollo Mboya against her.

The Commission further asked to cross-examine Justice Ndingu over the minutes held by supreme court judges on October 6.

Last month Mboya had filed a case against Ms. Ndungu and Jacton Ojwang accusing them of going on strike thus crippling court operations close to two weeks.

Judge Ndungu, however, filed an affidavit challenging JSC decision to castigate her, arguing that she was not accorded fair hearing.

The judge wanted the High court to determine the parameters under which the JSC can operate to avoid abuse of Commission's power.High court judge Mwita is set to give further directions on this matter on October 9.
