Supreme Court judge Smokin Wanjala has explained why he was not available when his colleagues were giving the full judgment on the nullification President Uhuru Kenyatta’s win.
A majority bench nullified the election on September 1 citing illegalities and irregularities.
The majority were CJ David Maraga, DCJ Philomena Mwilu, Justice Isaac Lenaola and Justice Smokin Wanjala.
Njoki Ndung’u and Justice JB Ojwang’ dissented.
Justice Ibrahim Mohammed was ill during the hearing and did not
write his judgment.
Wanjala missed during the full hearing which sparked discussions that he did not support the decision.
Speaking on Sunday, Wanjala dismissed the version.
He said he had taken his daughter to the US.
"This is a trip that was planned long before the general elections,"he said.
"Ours is a sick society where all sorts of idlers and busybodies create and feed rubbish to an ever gullible public," he added.
