[Photo|CGK]An Environment and Lands High Court in Kisumu has temporarily stopped relocation of Kachok dumpsite to Kajulu area in Kisumu East constituency, dealing Governor Anyang' Nyong’o a blow.Judge SM Kibunja issued the directive on Wednesday pending hearing of the case on January 18, 2018.Two petitioners, Fredrick Nyesi and Rose Nyanjong filed an application seeking the Court to issue conservatory orders to bar the county government from conducting the relocation of the dumpsite, which was one of Governor Nyong'o's 100 days in office flagship project.Respondents in the case who include Kisumu county, Doris Ombara and NAYA Holdings were restrained from commencing transfer of the solid waste from the Kachok site to Kisumu concrete quarry pit in Mamboleo.The two petitioners had argued that the county government through Ombara, unlawfully awarded a relocation tender for Sh99.25 million, contrary to Public Procurement and Assets Disposal Act, 2015.They also cited environment effects, saying the quarry was located less than 200m from River Kibos therefore would see toxic substances mix with water used for domestic purposes.County lawyer Geoffrey Yogi, however dismissed the application in court, saying it was premature since the process of acquiring NEMA licence was still on.
