Lamu senatorial results in the August 8 general election did not reflect the will of the people, Wipers’ Hassan Albeity has said.
Albeity, a former chairman of the defunct Lamu County Council, not only wants the High court to scrutinize the results but also recount all the votes cast on that day to validate his loss to Anwar Lotiptip of Jubilee Party.
The politician argued that the elections were marred by different forms of illegalities and irregularities that saw him lose despite the massive support he enjoyed from the people of Lamu, the Nation has reported.
In a sworn affidavit through his lawyer Yusuf Aboubakar, Albeity told the court that the Independent Electoral and Boundaries Commission (IEBC) barred him from appointing an agent to guard his votes per polling station, which is his constitutional right.
“Failure by the respondent to allow the petitioner to appoint an agent at every polling station breached the right to an impartial and transparent election,” said Aboubakar.
The politician, who appeared before Justice Asenath Ongeri, also argued that Daniel Kazungu Karisa from Dide Wa Ride polling station was seen filling Forms 38A, which is contrary to the election laws.
The incumbent senator and IEBC lawyers; Tiego Ongonya and Mr Benjamin Binyenya, asked the court to reject the application on the grounds that it had been filed outside the lawfully agreed time of 28 days.
