This is after Justice Lucy Gitari declined to rescue herself from hearing an election petition filed by Karua challenging Waiguru's win in the August 8 general election.

The NARC-Kenya leader had filed the application to have the judge disqualify herself from the case citing bias.

On Friday, Justice Gitari rejected the bid to quit case, saying she had no interest in the petition.

In her ruling she observed that the petitioner was 'in a spirited effort to shop for a judge who will rule in her favour'.

"The petitioner did not provide evidence that I have interest in the matter. In her submissions, she did not prove any aspect of bias as claimed," the judge noted.

However, in a quick rejoinder, Karua hit back at the judge claiming she refused to quit the case in order to hand over victory to Waiguru.

"By parity of reasoning then she is clinging to the file to rule in favor of my oponent," she tweeted.

Karua, who emerged second in last year's gubernatorial race, obtained an order from the Court of Appeal to have her petition heard afresh.

Justice Gitari had dismissed the case on grounds of procedural technicalities.
