A Kerugoya High Court has dismissed an application by Narc-Kenya leader Martha Karua seeking to have Chief Justice David Maraga constitute a three-judge bench to hear her election petition.
Karua is challenging the electio of Kirinyaga Governor Anne Waiguru in the August 8 polls.
Dismissing the application, Justice Lucy Gitari ruled that the court was competent enough to hear and determine the petition.
Justice Gitari observed that her court had been constitutionally established for the purpose of hearing petitions arising from gubernatorial contests.
"Any issues concerning the hearing of this case will be handled properly and competently by this court, having been duly appointed and as such, I hereby dismiss Karua's application as it lacks merit," said Justice Gitari during her ruling on Thursday.
The judge further dismissed an attempt by Karua to have the entire August 8 general election revoked on basis of the outcome of the presidential election petition.
The Supreme Court declared the presidential election invalid, null and void following a successful petition by NASA leader Raila Odinga.
The court cited irregularities and illegalities in the electoral process.
Gitari said her court didn't enjoy such jurisprudence to nullify the election in its entirety.
Karua was represented by lawyer Gitobu Imanyara while Waiguru was represented y Kamotho Waiganjo.
