The Kenya Broadcasting Corporation (KBC) has sued Mombasa Governor Hassan Joho for contempt of court.
The corporation has accused Joho of intentionally failing to honour a court order that prevented the county government from demolishing a perimeter wall that was built on a piece land allegedly owned by the corporation.
KBC, through their lawyer Protus Saende, want Joho, Mombasa County Secretary Francis Thoya and Lands CeC Anthony Njaramba committed to civil jail for demolishing the wall that was built around the disputed piece of land.
In a case filed before Mombasa High Court Judge Anne Omollo, Saende argued that the three decided to deliberately and willfully disobey an earlier court order issued on September 25, 2012 by Justice Mohammed Ibrahim.
The court order restrained the defunct Municipal Council of Mombasa from undertaking any action that will interfere with the pending hearing and determination of the case.
“The respondents’ action is in contempt of this honourable court. it is imperative that the matter be heard and determined at the earliest possible opportunity in order to preserve the dignity of the court and to stop further damage and interference with court orders,” said Saende, as quoted by Nation.
On April 27, KBC was given permission to fence the parcel of land located in Kisimani.
The corporation now wants the three to pay Sh1.9 million, arguing that was the amount it used to fence the land.
