Siaya Senator James Orengo wants the Independent Electoral and Boundaries Commission (IEBC) to halt its planned audit of the voters register until the Issack Hassan led team vacates office.
Orengo, in a protest letter, addressed to the commission secretary Ezra Chiloba, says the planned audit does not meet the standards agreed upon in the Election Laws (Amendment) Act 2016.
On Monday, the commission invited companies to express interest in the audit of the voters register according to the new elections law. They should tender in their bids by next Monday.
But the Senator, according to the Daily Nation, says the exercise should be undertaken by the new commissioners who will also supervise the 2017 elections.
“The outgoing commissioners have no legal competence and cannot constitute the commission as their numbers and appointment are now outside the legal framework. They cannot act in the capacity of commissioners. They are gone and gone for good,” Orengo said.
“The secretariat is, therefore, walking in a minefield that includes the arbitrary arrogation of the constitutional responsibility and authority of the commission. Be warned,” he said.
Orengo also questioned the IEBC secretariat's motive, saying some of its members would be vetted a new once the new commissioners are appointed.
President Uhuru Kenyatta last week declared the post of the IEBC chairman and the eight commissioners vacant following their resignation.
However, they will remain in office until new commissioners have been appointed.
