Over 1,000 Kenyan fishermen have resulted to taking legal action to compel Ugandan soldiers out of the disputed Migingo Island.

The Kenyans argue that their government has for a long time failed to act despite receiving reliable information about human rights violation by the Ugandan soldiers.

According to them, the Court must order the concerned government to declare the Uganda security personnel as 'personae non grata' on the island.

Led by Dr Dan Durell Alila, the traders and fishermen said residents had suffered and were still suffering under the oppressive and unlawful activities of the Uganda security forces.

"All this has been happening while the Kenyan security agencies have decided to remain inactive, passive and unconcerned. The said unlawful and oppressive activities have been in force since 2004 with devastating economic impact on the lives of the marginalised complainants and the general public," Dr Alila said.

The defendants in the case include the Kenya National Security Council, Kenya Defence Forces, the Defence Council, Ministry of Defence, Director of Public Prosecutions, Ministry of Interior and the Office of the Attorney General.
