Giving the ruling on Thursday, Justice Luka Kimaru said the application (to have Gicheru extradited) did not meet certain conditions.

“The application filed by the Office of the Director of Public Prosecution on May 28, 2015, lacks merit and cannot stand," the judge said as quoted by the Star.

The lawyer has been accused of bribing witnesses at the International Criminal Court during the cases that dogged President Uhuru Kenyatta and his deputy William Ruto.

The duo’s cases were dropped after the court found them not guilty of atrocity cases labeled against them after the violent nature of the 2007/8 elections.

According to the charges, the lawyer I accused of allegedly attempting to bribe six witnesses in 2013, as the cases were ongoing.

He is said to have offered up to Sh5 million to witnesses to withdraw from the cases.

The warrant was issued after Pre-Trial Chamber II, indicating Gicheru was in contravention of Article 70 of the Rome Statute.
