[Photo| pics.onemusic.tv]Kenyans will once again start celebrating Moi Day as a public holiday.This is after the High Court on Wednesday ruled that ommission of October 10 as a public holiday is an illegality and was in contravention of the Public Holidays Act.“I hereby grant a declaration that the omission to have the 10th day of October observed as a public holiday is an illegality and in contravention of Section 2(1) as read with part 1 of the schedule to the Public Holidays Act,” Justice George Odunga said in part of his ruling.Odunga, however, did not specify how the holiday should be marked.The judge also noted the holiday can still be scrapped if parliament amends the Act accordingly.The order followed a case where a Kenyan, Gregory Nyauchi, went to court to challenge the decision to omit Moi Day as a public holiday.The holiday was removed from the list of Kenya national holidays following the promulgation of the Constitution of Kenya in August 2010.
