The Director of Public Prosecution Keriako Tobiko has ordered an investigation into the conduct of top IEBC officials over illegalities and irregularities that led to the bungled elections.

In a communication on Saturday, Tobiko ordered the Directorate of Criminal Investigations Ndegwa Muhoro and EACC CEO Halakhe Waqo to conduct investigations and report to him within the next three weeks.

“I write therefore and pursuant to the provisions of Article 157 (4) of the Constitution… of the Elections Offences Act 2017 to direct and require you to, undertake jointly thorough, comprehensive and expeditious investigations into the irregularities and illegalities found by the Supreme Court to have been committed by the IEBC in relations to the presidential elections with a view of establishing whether electoral and or other criminal offences may have been committed by the IEBC officials,” he said.

His directive is a win for the NASA coalition, who have been pushing for the individuals said to have been the reason for the bungled elections to be charged.

Nasa had on Friday given Mr Tobiko 72 hours to file charges against officials accused of bungling the elections, saying they would also pursue private prosecution.

The coming week will be crucial, with planned meetings with all involved parties and stakeholders planned to clear the air that is already poisoned as the country plans to go to the polls again on October 26.
