Kericho magistrate Judith Nyagor who was arrested for allegedly taking a bribe to rule in favour of a suspect did not appear in a Nakuru court on Friday to take a plea because she is sick.
Magistrate Nyagor and court clerk Robert Cheruiyot were arrested on August 20, by officers from the Ethics and Anti-Corruption Commission for allegedly taking a Sh20,000 bribe from a client who had been accused of running a bar without a licence.
Cheruyiot who was present in court did not take plea since Nyagor was absent.
In a medical report presented to the court, her lawyers David Mongeri and Lawrence Karanja said she was unwell and urged the court to have courtesy on her until hopefully on September 3.
“The court has not given my client bond terms, it was a police bond and I hereby humbly urged the court to extend her bond terms and defer the plea,” he said.
Mongeri also urged the court to extend her police bond until Monday since the defence also does not want to delay the matter only that sickness has befallen her.
State Prosecutor Cosmas Kinyua wanted the court to issue an arrest warrant to the magistrate and her cash bail forfeited saying she failed to abide by the bond terms which required her to appear before court for a plea.
“She could have sent someone to the police station to extend the bond, she knows the procedures of the court,” he said.
Principle Magistrate Wakumile Ndururu affirmed that the court has considered the medical report and ordered the plea to be taken on September 3.
