Court of Appeal Judges Erastus Githinji, Fatuma Sijale and Anna Okwengu while sitting in Eldoret on Friday set the ruling date after Keter's lawyers gave their final submissions.

According to Keter’s lead lawyer Otiende Omolo, Eldoret High Court Judge Kanyi Kimondo erred in nullifying his win and want the decision overturned.

“The only reason that the judge nullified my client's election is that it' i alleged that he campaigned in four places on 6th of August which is not true,” Omolo told Journalists in Eldoret town, Friday.

He reiterated that the Judge of the High Court considered irrelevant matters, not within the hearing and petition and made the conclusion that was wrong in both law and fact.

Amos Magut the lawyer of Benard Kitur who successfully filed a petition against Keter at the High, however, insisted that a ruling to nullify the Nandi Hills Parliamentary seat was within the existing election laws and regulations.

On March 1 this year, High Court Judge Kanyi Kimondo ruled that there was sufficient evidence presented before the court justifying claims that Keter was not elected in a free and fair contest.

Court of Appeal Judges will deliver their ruling on July 11 at 2.30pm.
