Kilonzo was accused of colluding with IEBC official, Godfrey Ninito, in the electoral malpractice that saw her barred from contesting for the Makueni senatorial seat currently held by her brother Mutula Kilonzo Junior following the death of their father under unclear circumstances.

Kethi has contacted Tobiko to know the recommendations made by the former IEBC chairman Ahmed Isaack Hassan after her case was withdrawn. Hassan had written to Tobiko seeking to withdraw the suit on August 23, 2016. 

“Our request, however, should not be construed to mean that the complaint was unfounded or had no merits or that Kethi was a lawfully registered voter,” read part of his letter as quoted by Nation. 

Kethi and the official from the electoral body denied stealing IEBC acknowledgment slip between November 19, 2012, and June 27, 2013. 

The case against Kethi attracted mixed reactions from different factions with leaders aligned to the opposition accusing the government of political witch hunt. Kethi was taken to court with different charges including uttering false documents and handling of stolen property among others.
