Director of Public Prosecution (DPP) Keriako Tobiko has delayed making a decision on former Makueni senator Mutula Kilozo’s daughter Kethi Kilonzo’s theft case.
He is yet to terminate the voter registration theft allegations levelled against the lawyer. She faces the charges alongside Godfrey Ninito, an Independent and Electoral Boundaries Commission (IEBC) official.
Kilonzo has written to Tobiko seeking to know when the recommendations by the IEBC will be implemented. Former boss Ahmed Isaac Hassan directed that the case be dropped.
She has filled court papers that show withdrawal of the case by Hassan on August 23, 2016.
He wanted Ninito and Kilonzo to be acquitted. The former electoral boss urged the recipient not to link him with any suggestion that Hassan thought there was no crime committed.
In the confidential letter, Hassan said his action was not to be construed to suggest that no crime had been committed.
“Our request, however, should not be construed to mean that the complaint was unfounded or had no merits or that Kethi was a lawfully registered voter,” Hassan’s letter stated as quoted by the Star.
Keith argues through her lawyer Julie Soweto that Tobiko’s decision has not been communicated to them after denying the theft and withdrawal by complainant.
