The Supreme Court will this afternoon explain in detail why it upheld President Kenyatta’s October 26 polls win.
In the contentious polls that Raila Odinga withdrew, President Kenyatta’s win was upheld by the court.
The courts have the time to answer and explain key issues that led to the decision, with some legal experts pushing for the review of the presidential election framework.
Confronting the judges is the query on the legitimacy of the outcome an election that was postponed and later canceled in 25contituenties, which many argued that it contravened the electoral laws and the 2010 constitution.
According to lawyer Nelson Havi, who spoke to KTN, there are questions that the court needs to answer.
“The citizens in those 26 constituencies did not vote at all, are they obliged to recognize the presidency of Uhuru Kenyatta? That is a valid question,”
However, according to Githu Muigai, there is no perfect election and the October polls will stand.
“There is no perfect election, there will always be errors in an election, but you cannot invalidate an election unless those errors and discrepancies are of such a nature to affect the outcome of the election that is the law,” said Githu.
Another point that will be of interest is the legal explanation on withdrawal of Odinga from the running for the top seat.
According to legal experts, his withdrawal could have led to the cancellation of the presidential polls.
