Former Kakamega Senator Boni Khalwale now says Chief Justice David Maraga should take over realms of power from President Uhuru Kenyatta.
According to Khalwale, Uhuru's presidency lacks legitimacy as the October 26 repeat poll was 'shambolic'.
The FORD-Kenya deputy party leader, in an opinion piece published by The Standard, said Uhuru should step down for Maraga to enable the country to conduct a new election.
"The CJ needs to take over the State on a caretaker basis as we prepare for another election in 90 days," he stated.
Khalwale ruled out the possibility of National Assembly Speaker Justin Muturi heading an interim government, saying it would be 'illegal'.
"Muturi is not in this matrix because he was not elected by a supermajority (the combination of Government and Opposition MPs) and laws, therefore, bar him from assuming the leadership role of a caretaker government," the former lawmaker added.
In a recent press conference, Attorney-General Githu Muigai said Uhuru is in office legally, adding his term will end once another president is elected and sworn in.
"There is nothing like a transitional or interim government. Until the swearing-in of the newly-elected president, the government in office enjoys legitimacy. The legitimacy of the office is by full force,” the AG said.
