This follows former Kathiani MP Wavinya Ndeti's appeal against the governor's re-election on August 8, 2018.

According to the appellant court's ruling, the embattled Maendeleo Chap Chap party leader was not validly elected.

While issuing the ruling, the Court of Appeal ordered the Independent Electoral and Boundaries Commission (IEBC) to conduct fresh elections.

However, speaking later after the Judges issued a verdict, Mutua confirmed that he was going to appeal the Court decision in the Supreme Court adding that he will continue serving as the Machakos governor pending the determination of his appeal.

But while advising Dr. Mutua against moving to the apex Court, former Kakamega Senator Bonny Khalwale asked the governor to go back to the ballot and face his opponent.

" @DrAlfredMutua, wachana na mambo ya Supreme Court, go back to the people and face @Wavinya_ Ndeti, your opponent," Dr. Khalwale tweeted.

On her part, Wavinya Ndeti dared the Governor to go to the Supreme Court to appeal the ruling saying she is prepared to face him once again.
