Machakos county Deputy Governor Bernard Kiala has asked office of the Director of Public Prosecutions (ODPP) to withdraw charges filed by the office in a Machakos court against anti - IEBC protesters.

Speaking in Machakos on Thursday, Kiala argued that the charges were unlawful and unconstitutional as the Kenyan constitution grants every Kenyan a right to demonstrate and picket. 

 "Office of the Director of Public Prosecutions should withdraw cases for those charged during the anti-IEBC demos unconditionally and apologise unreservedly," he said. 

"Every Kenyan has a right to demonstrate and even to assemble. Therefore these charges are unlawful and an infringement of constitutional rights," he added. 

The ODPP filed a case against Joyce Ndungwa Nzioka, Dominic Mbithi David and Christopher Mutinda Muthini for an offensive conduct conducive to a breach of peace contrary to Section 94 (1) of the Penal Code after the three took part in an anti-IEBC protest on May 16, 2016 in Machakos Township.
