The County Government of Kiambu was on Monday barred by the High Court from evicting Madaraka market traders in Makongeni pending the hearing and determination of the case.
The case before Justice Weldon Korir was filed by Lawyer Harrison Kinyanjui on behalf of Thika Town MP Alice Ng'ang'a and Kabete MP Ferdinand Waititu.
Kinyanjui argued that the traders suffered psychological damage following the destruction of their properties in the November 22 arson attack.
The traders alleged that the Kiambu Governor William Kabogo had a hand in the attack and had even demanded that Kabogo record a statement with the police over claims of existence of cartels in the market which he accused of burning the market.
Kabogo, in his reply through his lawyer, wanted no reprieve granted arguing that there were already many pending cases in court and the suit did not show direct cause of his involvement or the county government.
He also wanted Waititu excluded from the case. However, both parties agreed to have all the cases joined into one and a date fixed for hearing.
The case will be mentioned on December 29.
