Kiambu tycoon Stanley Munga Githunguri has suffered blow after the Court of Appeal struck out his claim for Sh53 million compensation for trespass on his nine-acre Karen land.
The former Kiambaa MP had sued the Kenya National Highways Authority (KeNHA) and the China Roads and Bridge Construction Company for encroaching on his land for five months during the construction of the Southern Bypass, nearly four years ago.
High Court Judge David Majanja on March 21, 2014 ruled that Githunguri be compensated Sh100,000 in general damages.
The politician appealed the ruling but on Tuesday the three-judge bench appellate court observed that the Sh100,000 he has been awarded was reasonable and justifiable.
The National Land Commission (NLC) had gazetted the land for compulsory acquisition on August 23, 2013. The government acquired the land for the road project and fully compensated the businessman. It was transferred to the government on January 15, 2014.
