Kidero has sued the Kenya Defense Forces and its parent ministry for what he termed as illegally taking over of Mihango Road link in Kayole.
City Hall now wants the courts to intervene into the matter and stop KDF from digging trenches along the road.
Kidero has also sought an order of urgency to compel KDF to recall all its officers who have since been deployed along the city road.
Nairobi county government moved to the court for what it described as protecting the interests of city residents from being frustrated by the defense officers working in the trench.
The county administration noted that Mihango residents who have been using the alleged road for over thirty years were now being denied access by the ongoing activities of the KDF.
According to court documents seen by this writer, KDF started digging trenches across the link on October 24 this year without evident public consultation, which is in violation of legitimate expectations of locals from the affected estates.
“Kenya Defence Forces in utter abuse of their legitimate powers, have through their armed officers restrained Nairobi county government’s workers from performing their functions of maintaining county roads. This is in violation of core principles of devolution and also separation of powers as stipulated,” the suit papers read in part.
KDF however remains manning the road despite an ourtcry from the residents.
