The High Court on Friday dismissed a case in which Former Nairobi Governor Evans Kidero sought to block Ethics and Anti-Corruption Commission (EACC) from investigating his private accounts over the alleged loss of public funds.

In their ruling, Judges George Odunga, Chacha Mwita and John Mativo declared that the anti-graft body has the mandate to investigate the former county boss after suspicion that he transferred millions of shillings into seven of his private accounts.

According to the court ruling, the EACC and the Anti-corruption and Economic Crimes Act clearly stipulate the parameters into investigating such cases. 

The judges also ruled that it was unlawful for the former governor to rush to court in a bid to stop the commission from probing his accounts. 

The court ruled that the commission has the authority to obtain search warrants without involving the accused.

“EACC has the mandate to conduct investigations, there was no malice or contradiction whatsoever within the constitution regarding its mandate to obtain orders to search individual’s accounts. The search warrants for investigation can be obtained without involving the other party,” read part of the ruling. 

This came after Kidero filed a case that the High court to challenge an earlier decision of the Magistrate Court’s to grant the EACC access to his accounts.

The ODM affiliated politician has since maintained that he is innocent.
