Evans Kidero has been ordered to compensate the former county executive for environment, Evans Ondieki over illegal dismissal.
Justice Nderi Nduma of the Labour Court quashed Governor Kidero's decision dismissing Ondieki from office, saying it was done in a non-transparent and undignified manner.
Nderi said it was unreasonable for Kidero to sack Ondieki on the basis that he had been seen in a church service in the company of former Devolution CS, Anne Waiguru.
“The court hereby orders immediate compensation to the applicant with an equivalent to his full gross salary, less taxation during the unserved term of the contract," the judge ruled.
However, the court did not see the need to direct city hall to rehire Ondieki who has since opted not to serve the county.
The county government now has 30 days to compute the award and finally, file the same transaction for consideration by the labour court.
Ondieki had sued Kidero and his county government stating that his dismissal on January 26 from the environment docket was arbitrary and contrary to the provisions of the law. He submitted to the court that his sacking was politically instigated.
