A 40-year-old father of two who pleaded not guilty to defiling a six-year-old girl at Nyanchwa area as she headed home from school has been sent to jail for 50years by a Kisii Court.
The accused who was identified as Steve Mosioma was arraigned on Monday before Kisii senior resident magistrate Judicaster Nthuku and charged for defining the girl on June 22, 2017, at Nyanchwa location, Kisii County.
Mosioma was also charged with an alternative charge of committing an indecent act with a minor to which he pleaded not guilty.
The prosecution however overweighed the accused as he brought to court eight witnesses who gave collaborating evidence against the accused.
The prosecution revealed that on the material day the complainant met the accused at around 5 pm on her way back home from school.
The court was told that after the ordeal, the accused left and the complainant walked home where on arrival met her mother to whom she reported the incident.
As evidence, a medical report from RAM Hospital doctor also revealed that the complainant experienced partial penetration.
The court gave the accused 14 days to file an appeal.
