Kisii High Court has suspended a decision by a lower court to revoke the nomination of twelve Orange Democratic Movement (ODM) party Migori MCAs.

The twelve MCAs moved before the High Court in Kisii after a Magistrate’s court canceled their nomination.

The twelve MCAs had been nominated to serve at the Migori County Assembly as per the Independent Electoral and Boundaries Commission (IEBC) rules of nomination.

Rongo Magistrate Raymond Lang’at had last week on Thursday nullified the gazette notice that had listed the twelve MCAs for the nomination.

In his ruling, Magistrate Lang’at said that ODM party ignored the gender rule and the nominations were conducted in a defective manner.

The court ruled that their nominations were conducted in a defective manner adding that the political party’s tribunal had raised concerns over the list of nominees but ODM ignored and forwarded the contentious list of the nominees to IEBC for gazettement.

The petition was filed by some voters who expressed dissatisfaction with the ODM party list of nominated MCAs.

The twelve however filed the matter under a certificate of urgency before Kisii High Court Judge J Karanja who suspended the decision to revoke the nomination.

There will be inter-parties hearing on January 16.
