Kisii Law Court has dismissed a petition challenging Boikanga member of county assembly , Joseph Chweya.
The petition was filed by Paul Ayiema on grounds that the election was not free and fair.
In her ruling, Senior Resident Margistrate SN Obina ordered the petitioner to pay Sh 500,000 to the returning officer and electoral commission IEBC and Sh 300,000 to Mr Chweya.
The margistrate said that the evidence produced in court was not enough to nullify Mr Chweya's victory.
The Margistrate also said that he was satisfied that the election was conducted according to the election constitution act.
In his petition, Mr Ayiema argued that the election was manipulated and it was full of errors and irregularities.
In his defence, Mr Chweya said that he was legally elected as a ward representative.
He was elected winner with 1273 votes.
