The petitioner Mr Makori Onsando had filed a petition to challenge the victory of elected woman representative Janet Ongera.
In the affidavit, the petitioner didn't specify the polling stations which were to undergo recount and scrutiny.
The Judge stated that the petitioner was to be granted an order if he specifies the polling stations which were to undergo the process.
Makori stated in his affidavit that the votes the woman rep garnered were manipulated, a total number of votes cast were more than the registered voters.
Janet Ong'era garnered 172,482 against his competitor Dorice Aburi's 144,973 votes.
The parties will table out final submissions on 26/1/2018.
