A Kisumu Court has nullified the election of East Kano/Wawidhi ward MCA John Kennedy Ageng’o (Independent) from Nyando constituency.

Chief Magistrate Julius Ng’arng’ar has ordered for fresh elections in the ward after ODM candidate Julius Omoro petitioned the court over the MCA’s win.

Justice Ng’arng’ar in his ruling said the Independent Electoral and Boundaries Commission (IEBC) failed to adhere to the established regulations in the counting and tallying of votes.

He said scrutiny and recount in some of the polling stations including Kanyang’oro, Luora, and Nyakongo showed glaring anomalies in votes cast.

He said there were instances where crucial documents were being signed by IEBC officials without any proper reasons assigned.

He ordered IEBC to pay the petitioner Sh300,000 and also that the Sh100,000 deposited by the petitioner in the court be returned to him.

Julius Omoro while speaking to Ramogi after the judgment welcomed the decision saying justice had been served, adding that he is now gearing up for the fresh polls.
