The office of the Director of Public Prosecutor has been accused dragging the case of Kitutu Chache South MP Richard Onyonka involving corruption case.
The legislator lawyer Richard Onsongo said that it was agreed if Mr. Lazarus Sirtui is unable to sit session, then another office was to submit the files.
Onsongo told the court that the prosecutor Lazarus Sirtui failed to show up for court sessions Wednesday and today.
Chief Magistrate Thomas Obutu said that the Office of the Director of public prosecutor dragging the proceeding of the case.
"The DPP is messing up this case otherwise we could have continued with the case today," said Mr Obutu.
The case has been lying in Kisumu Court for the last 7 years since Anti-corruption has been investigating the case.
Kitutu Chache South MP Richard Onyonka and James George Siro are accused of withholding Sh.21,250,637 that was to be remitted to the Kenya Revenue Authority after the then Kitutu Chache constituency bought sugar from Chemelil Sugar Company in 2008.
Onyonka and Siro are jointly accused of evading tax payment. The legislator is accused on the basis of him being the then patron of the Constituency Development Fund while Siro is being tried on suspicion that he is the one who kept the Sh.21Million that was to be remitted to KRA.
Onsongo asked the court that the case be heard consecutively from Wednesday to Thursday next week.
Chief Magistrate allowed for the postponement of the case until next week on Thursday 7th May.
