Devolution Cabinet Secretary Mwangi Kiunjuri has received orders to gazette the commencement date for the Public Benefit Organisations Act in 14 days.
High Court judge Joseph Onguto gave the order after a successful application submitted by the Trusted Society of Human Rights Alliance.
Acccording to the society, it was illegal for Kiunjuri to fail to set a commencement date.
It argued that the Act was passed by Parliament in 2012 and therefore must have been gazetted as stipulated by law.
The PBO Act is a legislation that works on voluntary self-regulation to allow PBOs determine certifications, standards and adherence to a given professional code of conduct.
The court also received a request to amend the Act but rejected it on grounds that it was an illegal undertaking if done before it is enforced.
