Nakuru High Court on Monday acquitted the window of former Cabinet Minister, Mbiu Koinange, Edda Wanjiru and her stepson David Njunu of murder case.

The two were acquitted by Justice Janet Mulwa on behalf of Justice Hellen Omondi.

Wanjiru, Njunu and five other suspects; Nickolas Ngetich , Jonstone Segei, Steve Kiamba , Sagana Mbukoi, Kiragu Macharia had been accused of murder of a land rights activist, Moses Ole Mpoe and his friend Parasayia Ole Kitu at Solio junction on Nakuru-Eldoret road on December3, 2010.

It was alleged that Mpoe, together with Parrasaaiya were driving to Nakuru Town from Mau Narok, when their car was sprayed with bullets by hit men on a motorcycle, killing them on the spot.

In her judgment, Justice Omondi said that the prosecution failed to convince the court of the charges against the accused.

“The prosecution failed to seal loopholes that could be used as a basis of placing guilty on the accused,” read part of the judgment by Justice Omodi.

The Judge also pointed that Segei, Kiamba and Macharia were not mentioned by the prosecutor in the witness case, and were not linked to the murder.

After judgment, the accused expressed gratification over the court's ruling, saying that their rights had been respected.

However, the acquitted persons expressed their desire to sue the government over wrongful arrest and charges against them.
