Nakuru County Governor Kinuthia Mbugua will have to pay his former Chief of Staff two million shillings as compensation for unlawful termination of his contract.

On Friday, Nakuru High court ruled that Kinuthia irregularly fired the complainant despite 42 months existing contract.

Justice Stephen Radido said the right procedures were not followed when Komen was sacked after serving his employer for only 18 months of the stipulated period.

"Mbugua overstepped his mandate by purporting to terminate his client’s contract since he was not part of the agreement," read part of the Judgment.

Judge Radido said the employment agreement was between Komen and the Nakuru County Government Public Service Board.

Governor Mbugua had written a letter to Komen on January 5, 2016, asking him to explain why his contract should not be terminated.

The letter was followed by a termination notice on February 3, 2016.

Reports said that the former Chief of Staff absconded duty and failed to report to his office on a daily basis to serve members of the public as stipulated in his contract.

Komen, however, denied the allegations.

His lawyer John Githui said that the governor’s action was against the law.
