Kenya Airways has been ordered to reinstate its finance director on grounds that he was unfairly sacked.

While issuing the orders, a Nairobi court also directed that a compensation amounting to his last gross salary of 12 months be paid to him.

In her ruling, Employment and Labour Relations Judge Monica Mbaru said that Alex Mbugua was unfairly fired and that he should report back to work November 13 to hold the same position.

"I find no justifiable reasons to deny the claimant primary remedy of reinstatement as such shall redress all unfairness against him being taken of his position, he ought to have maintained as at January 19 last year," Mbaru said.

Through his lawyer John Njomo, Mbugua had emphasised on being reinstated to his former position and the judge said that "to order otherwise will not address unfairness against him to quantify damage cost in monetary terms would leave him in more damage than the reinstatement".

Mbugua told court that he was fired for raising the red flag on a cartel of suspicious ticketing and suggesting a review of the airline’s agreement with Dutch KLM.
