In a letter dated November 1, KRA legal services commissioner Wairimu Ng'ang'a declined to give the information saying it was confidential.

"The items are not in custody of the authority. The authority is unable to release the same to you due to limitations provided under article 24, 31 and 35," Ng'ang'a said in the letter to Mwangi's lawyer Gitobu Imanyara.

Ng'ang'a added that the request violated section 6(1) and (2) of the Tax Procedures Act and Section 125 of the income Tax Act.

Mwangi wrote to the Kenya Revenue Authority asking for Ruto's wealth declarations returns for the period he has been DP after Ruto sued him for defamation over a tweet published on September 30, that linked him to businessman Jacob Juma’s death.

There have been questions about Ruto’s source of wealth, particularly the millions he contributes in funds drives but the controversial activist denied defaming Ruto, saying in a 36-page defense and counter-claim affidavit filed at the High Court that the DP is a public officer, therefore subject to scrutiny.
