Gatundu South MP Moses Kuria and Homa Bay Women representative Gladys Wanga have kept the National Cohesion and Integration Commission (NCIC) in waiting for the better part of Tuesday morning failing to turn up for questioning on remarks they made during campaigns.
The commission had summoned the two leaders with Moses Kuria facing remarks he made against ODM party leader Raila Odinga while Gladys Wanga linked Cholera outbreak in parts of the country.
NCIC CEO Hassan Mohammed has said they have waited for the two leaders to honor the summon at 10 and had rescheduled meeting Mr Kuria to noon.
"On issues that affect peace,we call the people involved and interrogate them.Wanga could not be available on Friday and we expect her here today but it is not a must that they appear," said the CEO Hassan Mohammed.
The Homa Bay legislator who is not on a first time case on war of words directed to the president is to declined honoring the Tuesday summon.
On Friday she responded to the summons saying she could not be available.
It is still unclear how the commission will proceed with the matter given the stance by Mrs Wanga and Kuria.
According to the law failure to appear before the the commission will lead to legal implications as six months jail term or a fine of Sh 200,000.
The commission has held that they will proceed with writing to the DPP's office for the leaders to be arraigned in court even if they do not show up.
On the other side Mr Kuria had been linked to numerous inflammatory remarks and has spent several nights in the cells over insightful speech.
NCIC CEO says their efforts were bearing fruits as a number of leaders have court cases that have made several others more cautionary in their political sentiments' delivery.
