Kabete MP Ferdinand Waititu and his Gatundu South counterpart Moses Kuria has accused the prosecution of delaying the incitement to violence case against them.
The case failed to start on Tuesday over a documents hitch.
Prosecutor Duncan Ondimu urged the court to adjourn the case on grounds that investigations have not been completed. He said the State Counsel Nicodemus Maingi who has been handling the matter has since left the service for private practice.
Through their lawyers, they also accused the prosecution of failing to supply them with copies of witness statements and other documentary evidence which will be used in the trial.
“The accused have a right to fair trial and to be supplied with all evidence material in order to prepare their defence before trial,” said lawyer Harrison Kinyanjui.
Kinyanjui also said the way the prosecution is conducting the proceedings against the two is in bad faith.
"The accused were detained for three days at Pangani police station to enable police to complete investigations," he added. Milimani Senior Principal Magistrate Charity Oluoch directed the case to start on October 8.
“I have considered the request by the defence. I do agree that police had enough time to prepare for the trial. Accused persons have a right to a speedy determination,” Oluoch said in her brief ruling. Kuria and Waititu are accused of threatening the life of opposition leader Raila Odinga.
They have denied the charges and are out on a Sh5 million bond each.
