Gatundu South MP Moses Kuria and former Machakos Senator Johnson Muthama were on Monday arrested over claims of hate remarks they made before while speaking in political rallies.

The two are to be charged in court on Tuesday morning after spending the night at the Pangani police station.

The politicians will be expected to appear before Judge Francis Wandai at the Milimani High Court.

Muthama will be represented by lawyer John Gaminwa while Kuria's lawyer is Cliff Ombeta.

Kuria shared a video on his Facebook page while at the Pangani cells where he condemned his captors and alleged that he is not guilty but Muthama is.

"How is it then that after Mutham spoke they wanted to arrest him, they couldn't do it without Moses Kuria being arrested first. How to you arrest an innocent person so that you arrest the guilty one," said Kuria.

"Moses Kuria has children who see what is happening on social media. When they see these things happening to their father they are not happy," he added.

Director of public prosecution Keriako Tobiko asks for more time to decide whether or not to charge Senator Muthama; Moses Kuria's lawyer Cliff Ombeta has asked for his unconditional release.This is not the first time these two politicians are caught in cases of hate speech, in June 2016, they were detained at the Pangani police station.
