However, Miguna Miguna who has not commented on the matter still has a lot to clear before vetting. 

County Assembly of Nairobi speaker Beatrice Elachi said they have to wait for the government to give final rule on Miguna Miguna's citizenship before they proceed with vetting.

Miguna Miguna's lawyer Nelson Havi has come in to defend Miguna Miguna against such plans by the county assembly to 'subdue' his nomination as DG for Nairobi over claims of him not being a Kenyan citizen.

Through Twitter on Thursday, Lawyer Havi squashed Elachi's sentiments that Miguna Miguna cannot be vetted for DG before state clarifies his citizenship.

Havi said the constitutions stipulates that the Judiciary is the final interpreter of the law and its decisions are the final.

"Beatrice Elachi can’t assert that Miguna won’t be vetted for Deputy Governor before State clarifies his citizenship. Under Article 159 of Constitution, Judiciary is the final interpreter of law and its decisions bind Executive and Legislature. The issue has been determined," Lawyer Nelson Havi saidsaid on Thursday.

Miguna Miguna's entry into the country has been marred with controversies over his dual citizenship status. He was to fly into the country on 16 May but he cancelled the travel after he was short of Kenyan passport to facilitate his flight back to Kenya.
